It is your former employer's responsibility to pay over the tax and NIC he has taken from your earnings under PAYE. If he does not do so HM Revenue & Customs (HMRC) will go after him and interest and penalties are likely to apply to him - see attached HMRC web link www.hmrc.gov.uk/paye/file-orpay/payments/deadlines.htm#5 .Presumably you have been given payslips and a form P45 when you left to prove the deductions that have been made. Although it is possible that HMRC will not be able to make a tax refund to you, if one was due, because the monies have not been paid over, it is likely to go unnoticed for a while particularly if you start a new job and give your P45 to a new employer. You will however not get a credit for the NIC on your NIC record, which may or may not affect your state retirement pension entitlement in due course, depending on the number of qualifying years you have.
