I'm a leaseholder and live in a bottom flat and we share a garden with the other leaseholders being the upstairs flat. The freeholder is a mgmt company in the city. We own the left hand side of the garden and the upstairs flat own the right hand side. We have put in a fence down the middle of the garden so we can have our own private part of the garden. Do we need the freeholders permission? Are the height restrictions to the fence dependent on the council and not the freeholder?
