Hi. My house is split into 4 flats. I have got planning permission to split into 4 decision notices attached. I need to know if I need to get building regs certification / approval before I legslly split refinance on 4 titles (ltd co ownership plus four leaseholds) or can i do it now and get buildjng regs retrospectively . Really you should get building regs approval prior to any work which you want to carry out to the property in the circumstances you describe.

Conversions of properties require approval under the Building Regulations.

You may need to consult the Fire Service regarding issues relating to fire escapes.

In addition the Housing Act 2004 requires that sub-divided buildings meet standards and houses in multiple occupation are licensed. As such I would suggest that you contact the planning department at your local council who can assist you with this process. I hope that this helps and please rate positive.

I have a rental property which was let last august to an
i have a rental property which was let last august to an american family on a 12 months tenancy. the rent was £2220 per month and they paid a deposit of £2200. However I failed to register the deposit with a TDS which I now know to be against the law. The tenant decided after 6 months that because their children were unhappy to live so far away from their friends rhat they wanted to leavethe property 6 months early. I was reluctant to agree to this as I would be left without rental income and looking for a new tenant. The Americans asked the housing officer at the American air base to help and at this point I was made aware by the housing officer that I had broken the law in not registering the deposit and that the potenital penalty for this was return of deposit plus up to 3 times the deposit as a finacial penalty. In light of this I reluctantly accepted 1 months notice although i didn't put it in writing but as I knew i was facing a potential financial liability thought that settlement of the matter was in the interest of both parties. under the advice and written instruction of the housing officer I retained the deposit in lieu of the rent covering the 1 month notice period. I did not pursue any further for the remaining 6 months rent for the unexpired 6 month tenancy. I assumed this to be the final settlement of the matter. However the tenant has come back threatening to take legal action for the non protected deposit unless i pay it back immediately. I have offered to pay it back even though i was instructed to keep in in lieu of rent. they now want extra money for oil which was stolen from the oil tank during their tenancy claiming I owed them a duty of care under the conumer protection regulations 2008 in respect of anti social behaviour , repayment of costs for installing security lighting and some money for gardening . the amount demanded totals £3600. At then moment I have offered to pay the deposit back as i believe I am legally obligated as a minimum, I beleive my responsibility to them in terms of consumer protection relates primarlily to the rental property about which I have made no false statements, representations or claims. The property is in a rural area with no mains gas so oil is main fuel source . In 13 years the oil has been stolen twice. Do I have the right to pursue the tenant for breach of contract with regard to the unexpired tenancy agreement ? The unpaid rental income would amount to £13200. … read more
