We have a path over which we have a vehicle right of way and a land registry plan confirming the boundaries of the right of way. Now we have found that a narrow strip of the right of way is shown on the land registry title of the adjoining owner. We do
not dispute this ownership.The path is currently unmade. Are we entitled to lay a tarmac road on the full width of the path to improve the right of way?

What does the title say about repair, reinstatement and maintenance of the right of way as regards ***** ***** proprietors?

Customer: replied 1 year ago.
Nothing, No one owns the right of way (apart from the narrow strip previously mentioned) - it is the burdened land of property we do own. No one else has any right to drive vehicles on it - just us.

If there is no right grants to maintain the narrow strip then you would need the consent of your neighbour who owns it.
