I have own a leasehold flat. Is it within the law for my Landlord

This answer was rated:

I have own a leasehold flat. Is it within the law for my Landlord to have the "same address" and some of the "same directors/company secretary" as the Managing Agent?
can we please have the full background detail? Thank you

Thanks for responding.

Communications from my Landlord come from the same address as those from the Managing Agent. When I made some casual online enquiries, I can see that both companies have at least one director who is the same person. I would just need some clarification on how separate the two entities must be.

There is actually no requirement for there to be a managing agent
unless it is specified in the lease it is not at all uncommon to have the
shareholders and directors the same provided there is not a conflict of

The freeholders can decide to appoint one of their own volition

Indeed, it is not uncommon for leaseholders themselves to be
shareholders and directors of Freehold companies or management companies.

There is nothing actually wrong per se in what is happening here
provided there is no element of self-interest when it comes to the landlord
company appointing the managing agent company.

However you will usually find that the managing agent company is
appointed in the lease
