for Ben Jones...I was charged...
for Ben Jones...I was charged with firearms act 1968 S1(1)(A) ..and (B)...one was 22 live bullets I forgot were in my unused gun safe...this was dropped by prosecution...but ( B) ..I think was for an air gun moderator...now becomes a flash suppressor?..in prosecution documents in court..I cant remember seeing this item for years...in my gun safe..They have not shown it to me...I suspect an air gun moderator..would not meet high spec needed for a firearms flash suppressor?...depending on internal materials...of baffles materials..perhaps made of plastic/ rubber/ foam?..How do I or my counsel handle this..they want me to plead guilty..presumably for dropping ammo charge?.. .

The item is a sound moderator, it might only be described as a flash suppressor if its internal components are high temperature alloys....or in fact if there is nothing inside the tube...I would have thought.. How can prosecution define it correctly if the inside is not examined?...If it was so inspected...are they obliged to inform the defence.

I already stated that my firearms certificate was lapsed...already mentioned counsel wants me to plead guilty....what is the legal position regarding the technicalities I have outlined to you regarding this item..sound moderator or flash suppressor?..

On the face of it, you should be following advice.

I'm really sorry but I can't see a defence.

Obviously I haven't had fully view of the evidence but this is clearly a firearm requiring a certificate. Otherwise why did you have one originally?

I have had vision of the case but if you are being told to plead then this weapon is clearly in need of a licence.

i am sorry and I know the minimum term is unattractive but I can only give you a truthful answer.

The air gun sound moderator and a flash suppressor do need a licence ...but the item found in my safe is only a sound moderator...not technically suitable to be legally described as flash suppressor as the prosecution have done....in my view..
How are they able to do that... charge me with something I do not have.?...It there not a legal definition that separates these two items?...there must be...as the situation could be very dangerous .
what is min term and is it same for possessing either one?..
The officers searched my gun safe without a warrant...stating they could because I had a gun safe...and previously held a gun licence. I thought that was only permissible if there was a registered gun currently at that address? this that correct?
