Hello. I would like some advice if possible. Last weekend I was away with my partner for a weekend. We had previously experienced relationship issues whereby she had been proven to be lying and cheating on me with other men. I had previously ended our relationship on that basis that she couldn't be trusted and I couldn't be in a partnership where trust and respect were absent. However upon finishing the relationship my partner fell into deep depression and threatened to kill herself if I did not make contact with her. Despite the distrust in our relationship I still had feelings and empathy for her and agreed to help her. As time past she convinced me to give her another chance. On our weekend away we were in our room, when she went to the lobby area to order some food a message popped up on her phone from one of the men she had previously cheated on me with. We had agreed that no further contact would be made and was a condition of giving our relationship another try.
When she returned to the room I asked her why this man had text her and was upset that she hadn't blocked him and was still in contact with him. She had no explaination for this and went on a verbal attack. Having experienced her rage previously when she was found cheating I told her that it was not acceptable and I did not want to be near her and made a move from the bed to exit the room. She immediately blocked my exit and continued to shout abuse at me. I became very anxious and angry about the situation and grabbed her arms to try and move her from the door so I could exit. She resisted and dropped to the floor, kicking out at me. I grabbed her legs to stop this and pulled them towards me to try and clear a path to exit the room. There was a further struggle and physical grabbing of each other, at this point I grabbed her hair, pulled it in a further escalation of the situation, I stood up and grabbed some cold hair straighteners, threw them at her and they hit her hand. At this point I realised I had caused her pain and the situation was immediately calmed. I packed both of our bags and helped her to reception where I asked her whether she would like to go to hospital, she refused, so i called the police. The police arrived and I discussed the matter with them, I was immediately asked to take a seat in their car and after initial investigations at the scene I was cautioned and arrested for suspected GBH. On arrival at custody I was advised that the GBH arrest was amended to ABH, possible common assailant by battery. I asked for the duty solicitor and chose for the option to admit the account as described above in interview. There is an additional allegation of criminal damage to property to value of £500 which I did not admit to as do not recall damaging any items other than the hair straighteners as mentioned above. I was completely complicit with the police in every possible way. I was advised after the interview that I would likely receive a police caution for Assulat by battery as injuries where only mild upper limb bruising commensurate with the account above by both the interviewing police officer and my duty solictor.
I was finally charged with assumption by battery and criminal damage to property to the value of £500. I have a court date to attend with a couple of weeks. I am a 40+ year old professional, with 50% of my child prom a previous marriage. I have no criminal history and would like to understand what the likely course of events will be and like stencing considering the above which reflects my statement made to the police in regards ***** ***** incident.
