Customer Question

JA: Hi. How can we be of help?
Customer: I was diagnosed with PTSD following a rape and started a claim for ESA September 2014 and HB. In May 2015 I started working until December 2015. And then again Feb 2016 Until the end of this month. I did not inform the benefit office I was working as well as claiming for all this time. Now I have signed off and my job ends the end of this month. Will I go to court and jail, As if fraud is on my police check I will never be able to work in my role again. Please help I have become very unwell I have never done anything like this before
JA: Because employment law varies from place to place, can you tell me what state this is in?
Customer: The UK
JA: What action has been taken so far? What's your ideal outcome?
Customer: No action soo far but they will find out
JA: Anything else you want the lawyer to know before I connect you?

Did you have this job at the time you opened the claim?

Customer: replied 1 year ago.
No I initially openned the claim in September 2014 and did not start the first job until May 2015, this lasted until December 2015. I then had a period of no work for the month of January and started to work again in Feb 2016, this job ends on the 30th of this month.
So apprx 1 year and 3 months I was claiming and working and not declaring this

OK. It is likely that they will prosecute then. This is just too high an amount to address in any other way.

Expert:  Jo C. replied 1 year ago.

However, there is no prospect of custody.

A £12k fraud would attract a community order at the most.

It isn't aggravated by this being a false claim from the start or really any other feature.

Beginning to repay the sums taken would be very helpful to your mitigation.

Can I clarify anything for you?

Should I contact them now or wait until they find me? As I have no access to funds until I find work?
Expert:  Jo C. replied 1 year ago.

Have they not found you already?

Customer: replied 1 year ago.
No but I know it is coming, I am soo worried. I have an absolutly clean record, I have never don this before I dont know why I have dont this to myself,
Expert:  Jo C. replied 1 year ago.

Why do you know it is coming?

Customer: replied 1 year ago.
Well its benefit fraud and the goverment always find you in the end. I am thinking at this stage because I will be prosecuted and sent to court, this will ruin my career as I need to have police checks to work in my field. Noone will employ me. So I may as well wait for the letter?
Expert:  Jo C. replied 1 year ago.

there is a risk that could happen but it is not certain.

You need to decide whether you want to take the risk.

There is a chance you would not be caught. Many are not.

Its hard. As I want to be honest but at this stage I have soo much to loose. Its stupid, as it has made me even more unwell.Thank you for all your advice.
