We are in the process of buying a new build semi detached

we are in the process of buying a new build semi detached property. We Have exchanged contracts but now, at the last minute, discover the builder has sold us land (the garden) that he does not own.
This strip in question is between our house and the house behind our garden and is in the process of being registered by another developer.
The builder had originally purchased the site with a bungalow on it , which he demolished and built the two semi detached properties on. He claims he had no knowledge of this situation and erected the boundary fence next to another already insitu.
His solicitor claims that they were in fact selling us the title to land he did not own and that we should complete the purchase regardless. Our solicitor says he could not have discovered this situation before exchange of contracts. Help! We feel we are being bullied into completing on a purchase that we will not own a part of

How was the solicitor unable to have discovered this?

it can only be revealed when the proprty is registered at the Land Registry
