Hi, we have recently sold a man some stone which we delivered and he asked us to send a bill to his company. He has not paid the bill and has gone bankrupt. The stone we delivered was on someone else land, can we take the stone back off said land?
Thank you for your question. what terms did you sell on? Normally you have to expressly reserve title in order to take goods back for non payment. If you did not do that then normally title passes on delivery and strictly you cannot claim it back. However if you delivered it to someone else and you can get access then form a practical perspective I would take it back. If you can get possession there is not much he can do about it.
