On the face of it there is a defence then.
They do have to prove that you were driving whilst in drink. It is a defence to say that you consumed the alcohol after driving.
However, this is a fairly common defence call the hip flask defence and it can be knocked down with a BAC calculation if its findings are not in your favour.
Generally speaking the longer the time delay between the driving and the sighting by police the better.
All that said, if there were not some recent evidence of driving then I would be surprised to find you charged.
