As the property is still in Gran's name, it is up to her Administrator to deal with any transfer of the property into the beneficiary's name, Uncle J. As your Mother has died, it is up to her Executor or Administrator to deal with the transfer, which is you or your Brother.

It will be necessary for you to apply to the Probate Registry for what is called a grant of letters of administration de bonis non which is obtained to complete the administration of specific assets following the death of the last surviving administrator of an estate.

Although Uncle J is therefore correct, under no circumstances should you be responsible for any fees in making this application- they should be divided 3 ways between you and your Brother/ Uncle J / and Uncle B, as it forms part of the costs of your Gran's Estate.

I would therefore suggest that you put this forward to Uncle J.The procedure for obtaing the Letters of A de bonis non is relatively straight forward-although you may wish to instruct a Solicitor to deal with this, as a Solicitor will normally deal with the Transfer of the Property and registering the Transfer at the Land Registry.

Hi Carole,

If you do receive £X and in return transfer the property to Uncle John, and sign a form to that effect, then you are saying that the property is now his, and he is then free to sell it/leave it to whoever he wishes in any Will he may make.

Therefore, you should really be getting 1/3 value of the property from him, less an amount for any maintenance costs/insurance he has paid since your Gran died.
