Yes you can still be arrested as this is theft.

It is possible, although unlikely that any Police action would take place, as the Police would have most likely arrested and detained you when it happened.

I realise it was a mistake, but that is not a defence.

The store is entitled to ban you if they want to and in law, there is nothing you can do about that.

All you can do is put across it was a mistake and that you are sorry - but the final decision to ban you is up to them.

I am sorry if this is not the answer you are looking for but based on what you have said, this is the legal position.

There is no rule which says shoplifters have to be detained at the time. In theory therefore the police could still arrest you for this "offence". However, it's unlikely they will now. Shoplifting is in practice an offence for which offenders are arrested and dealt with at the scene then taken immediately to the police station. If the police weren't called then, it's not really likely the shop will call them now. In effect the shop feels it has dealt with matter by banning you. If the worst case scenario happens and the police do come to speak with you about this incident, make sure you keep the receipt and show them the list of the many other items you paid for at the time. This will help persuade the police there was no dishonesty involved because you had made a sincere mistake. Please son't worry though as it's far more probable you've heard the end of this matter.
