The signage around the site explains the Terms and Conditions of parking and consequently, a contract is formed when the driver accepts the offer
to park.
As you have not provided details of who was the driver at the time of the unauthorised parking event, our client may decide to make an application
to the Court for an order under 'Civil Procedural Rules 31.16 • 'Disclosure Before Proceedings Start' The effect of this order will be to involve
you in any legal proceedings raised by my clients in connection with this debt.
Alternatively, they may decide to issue proceedings and rely on the established principles in the following cases:
1) Watteau v Fenwick (1983): This establishes the existence of a principal agency relationship, where the principal (in this case the Registered
keeper) is responsible for the actions of its agent (in this case the driver). In the event of non-disclosure, the principal will be liable for the charges.
2) Combined Parking Solutions v S J Thomas (2008) :The defendant denied or never accepted he was the driver at the time of the offence but
the court found that on the balance of probabilities, he was, and found in favour of the Claimant.
It is important for you to understand that although you may not have been the driver at the time, in the absence of driver details; our client is within
