Ok. Obviously what you did wasn't particularly commendable but you can't spend forever feeling guilty over that and, to be fair, there are this who would think what she is doing is worse than one minor common assault.

Making untrue allegations of rape are defamatory. There is little real question over that. Making false allegations to the police is perverting the course of justice but she hasn't done that unfortunately.

You could sue her for defamation. There are various problems with that. The first is that there is a lower standard of proof in civil matters and you wouldn't want to risk the court concluding that you probably didn't this bearing in mind there is a caution for common assault. The second is that a defamation action is extremely expensive costing in excess of £25000.

There are things you can do about this. Personally I would take it back to the police. This probably amounts to a harassment or a malicious communication at the very least. They may not be that keen obviously but you can always raise complaints about that. It's about time they did something about women like her.

Obviously you do run the risk of her then making allegations of rape though. She would have to account for why she didn't declare earlier but the excuse usually offered for that is trauma and there are people who will accept that. Probably you wouldn't be charged but you do face that risk.

Overall though, if this is not getting any better then you have to take action whether it's inflammatory or not.

Find yourself a sensible girlfriend. I'm sure you probably were behaving badly that night. We all have rows. We don't all get the police involved in them.
