in 2008 afriendof mine was convicted for what is termed as kurb crawling.the event of the offence was that he was driving a hired car with a friend.waiting at a set of traffic lights the friend jokingly wolf whistled and made a gesture to a female on the pavement. 100 yards down the road a police car pulled him over and accused him of the offence. he denied the accusation yet still the police prosecuted.being the driver the offence directed at him. how the police could have accused him of kurb crawling when they were nowhere insight,one can only wonder was the womwn in question a plant? my friend attended court with his mother.The clerk of the courts advised him that should he plead innocent a larger fine and a record would be imposed.So upon the clerks judgement he pleaded guilty and the magistrate incurred a fine of £350 and advised catergorically that as this was his first offence the fine was suffice and he would not received a criminal record. One had assume that thid case was closed. Most recently he undertook employment subject to a CRB search and the reports indicated the above offence. This has led to his termination which he is devastated.The company has given him 7 days to resolve his innocence which he would be re-instated.With all the assumed facts that i have described can he return back to the courts and have the criminal record overturned? or what else can you advised?
