My sister went to a local shop and bought a few groceries including a bottle of wine and went home to have a drink. Approximately 30-40 mins later 2 female police officers arrived at her house and asked her if she had been at this shop to which she said yes. They then went on to say that she had been reported by a member of staff who thought she was intoxicated.

My sister lives alone and suffers from very deep depression and hardly ever goes out on her own and when she does she gets very flustered and shaky at times she also suffers from problems with her walking due to fluid in her ankles due to her medication.

These 2 police officers pushed into her house and told her she was under arrest for suspicion of drink driving. She was stunned and frightened so she rang me and I askd to speak to the policewoman. I tried explaining that my sister suffered from very bad depression and under these circumstances her carer would have to be with her. The officer told me she was not interested in discussing her condition and that if the carer did not arrive within 10 minutes they were not going to delay the process any longer. I then asked her to put me back on to my sister and she refused and she hung up on me.

Her carer arrived in with her and witnessed them harassing her and trying to handcuff her, she was hysterical. By the time the carer arrived they had taken a breath test which was 50. The bottle of wine that she had bought was sitting with about 3/4 of it consumed, to which the police officers noted in their report. They told the carer that she would have to be taken to the station and that he could follow them down. In the station 2 readings were taken one 41 and the othe 43.

They told her carer that cctv footage showed her in the shop unsteady, she is like this when she is among people she panicks and feels shaky and she rarely does go out on her own.

She was not stopped in her car, 40 minutes elapsed until the police arrived at her door accusing her of driving whilst under the influence, during this time she had drank 2 full glasses of wine and was in her nightwear ready for bed and had taken her nightly medication when they arrived at the house. She was forced to go to the station in her night wear. As she was under the reading of 50 she was told she had the option of providing a blood test which she did. They also said that because of her mental state they would be having her assessed and also tested for prescription drugs, none of these were carried out.

This is the full story, my question is how can the police come to her home 40 minutes after being reported, force into her home and her on her own, and totally disregard my concerns to them about her mental health. I told them she is under psychiatrist and social wokers, but made no difference. How can they take her away to the station when no crime was committed, she was not drinking whilst driving, it was her condition that made her appear acting strangely and treat her this way. How can a cctv footage show if somone has been drinking, this is what they are going on nothing else.

She doesnt drink and drive and is devastated at this treatment and is now terrified of being convicted of something she is not guilty of. How can this be right. I would appreciate your comments. I intend to make a full complaint.
