Hi - To be frank no I do not think that the Court will view this settlement as fair and it is unlikely that the Court would seal the order. However this does not mean that you cannot go ahead on that basis. If you have been separated for three years and both agree to a divorce then the obvious ground to use is the two year separation ground. Claire

HI - The online companies are incorrect - the District Judge does have the power to refuse to make an order that they do not believe is reasonable even if the other party says it is what they want - and I have known it to be exercised. They are more likely to agree if the other spouse has legal representation - but I have still known them to refuse in those circumstances. -- However even if the Judge refuses to make the order they will not impose an alternative UNLESS a full application is made by the other spouse - so whilst the court may refuse to make the order you and your ex can still go ahead with the arrangement if you wish. -- In addition even if your ex did apply to the Court I do not think she would get a 50/50 split or indeed anything close. -- However clearly what I cannot do on the basis of the very limited information available on a question and answer forum such as this is give you more than a broad outline of the possible result - I do not know all the details of your case: I do not know the Judges in your local court (unless it is Derby or Nottingham of course) so I can only give you a guide not a final yes or no - but certainly I would not expect this order to be endorsed as things stand . Hi - The Dubai divorce will be recognised - but there is a provision under UK law for her to make an application for a financial settlement here in the UK even where the divorce has taken place overseas. Claire
