Verifiedhi - by moving out you are not forfeiting any rights in the house whatsoever - but you are being sensible and ensuring that there is no risk of a confrontation which would make things worse for your child and could lead to you being excluded from the property by the court - assuming that you can find somewhere to sleep other than the car then staying away at night but returning to care for the child is sensible as it increases the chance of a shared residence order in respect of the child in the future - please do not allow your wife or her boyfriend to provoke you into violent behaviour again - and please also seek face to face legal advise as soon as possible (nit advice from friends!) - claire
