Please can you assist or help me in some way.
I have been separated over 5 years with an 8 year old son. I had a property before I was married and sold to put a down payment of ?35k, husband put down ?15k, house was bought for ?99k and the majority went into the family home and over ?17k loan to my husband for various things. In 2004 things were not great with the marriage and he had an affair, always out and away at weekends even though we had a small baby. In 2004 he borrowed 30k on a secured loan against the house, I was not happy and told the company but I had to sign as he said that the mortgage would not get paid. I have always worked and we had an arrangement that I paid all the household bills, childcare and he paid the mortgage and food shopping, we both had cars, I paid for my own as did he. He left just after receiving the monies and said that he would continue to pay the mortgage, he was in constant touch with our son and paid a small amount to help with the food bills, I still continued to pay all the other bills as usual. He moved in with his lady friend. In 2006 he wanted to borrow 60k on the mortgage to pay of the 30k on the secured loan, this again I had no choice but to sign so I did. Two years ago I was notified by the bank that the mortgage hadn?t been paid for over 8 months, my husband ensured me that it was. His parents paid the arrears, since then 15 payments have been missed. He moved into the ladies marital home after her divorce with her children who are over 18, and I remember him saying that her husband lived there? I checked the title deeds of her property and there was his name along with hers, I mentioned this to him and told him to pay back the 90k on our house so I can then pay the mortgage which is only 70k and I could afford with some maintenance from him. He has so he tells me had problems with his tax, he got made redundant two years ago and said that they had messed up his redundancy money and he was waiting for it. I still haven?t seen anything or heard any more from him. He is now redundant and taking his former employer to court for nonpayment of works. I have received no monies from him in last 7 months and since he has left he has not maintained the house in any way shape for from, I have bought our son his school uniform since he started school, new bed for him , washing machine , all the painting and decorating in the home. Now the mortgage is 6 months in arrears and so is the secured loan. I have had got agree to give them ?125 a month to keep the bailiffs from the door, this I cannot afford. The only way is to sell the house but there is no equity and I can only really get back just enough to pay of the debts. I found out that the 30k was paid to his creditors in the form of cheques written and he had a cheque for ?3500 for himself, we don?t have a joint bank account so I have no idea where the rest of the monies went as he won?t tell me, I have a suspicion that he put the monies or some of them into his partners property. After I mentioned this the title deeds were changed to exclude his name. I have asked the bank to tell me where this 60k went but as it?s a single account and data privacy they won?t divulge the information but they are asking me to pay it back? Surely there is a way I can get the bank to investigate>
