I have a residents order...
I have a residents order for my 8 year old daughter. She hase been having behaviour problems and has been under educational psycologist and had been referred to an ADHD specialist. Her father had previously had limited contact having her on say 3 occasions per year. I decided due to her condition, to let her go to her dads to live to see if she settled in a different environment as she would be with children of her own ag. This was only on the condition that she settled and if not she would come straight back to me. This was 4 weeks ago and I have now received solicitors letters threatening to take me to court if I do not change the order, and in addition starting over again petty accusations on the way I ask if she is ok and my partner worrying about her losing weight. I thought my ex had changed and it is becoming clear that he will go down the old route and try to get custody through the order and limit my contact had he had done with one of our other daughters. Where do i stand?

As he seems to be playing the old nasty games i would like her to, yes. But this was not the point of her going, it was for her sake to see if she settled and it helped her. I wanted to give her time, and in my eyes it is up to my daughter if she is happy, not us. It frightens me that if I give the order now and she wants to come back that I will loose contact.

At present phone 3 times a week and can see her when I want to, but this is likely to change if he gets the order. He stopped me seeing my other daughter and having contact for over 3 years,although she is now almost 17 we do now talk but obviously do not have the mother daughter relationship i would like. I am very concerned that this will happen with my youngest.

hi

i am afraid that your daughter is to young to be responsible for the choice of which parent she lives with - this is something her parents must agree on - and if they cannot then it will be for the court to decide

if you agree to an order transferring residence - or if the court chooses to make one - then you can ask for a specific contact order setting out what contact you are to have with your daughter
