Yes, he can take her to court to get access to his child. Its a probably a good idea to get a court order for the purposes of clarity anyway.
Your claims about his criminality will be considered by the court but allegations of this kind are very common and courts do consider them on their merits. Generally he'll get access in a contract centre to start and then unsupervised access unless there are problems.
The CSA matters are separate. Not being able to get access to his money is not a ground to stop contact.
