VerifiedThere is another way of dealing with this.
The commission owed is part of your wages you can apply to an Employment tribunal whilst still remaining in your job for Unlawful Deduction of Wages. This has the advantage over County Court proceedings that no fee is payable to issue the application and the proceedings are quicker. Also if as you suspect the company is insolvent part or all of the outstanding wages can be paid by a Government fund for redundancy payments, outstanding wages etc.
