Hi, I work in finance in...

Hi,

I work in finance in Australia and have just met with a client who has recently emigrated to Australia from the UK, she has permanent residency in Australia.

She has unsecured UK debts of 100K (Pounds).

In Australia she and her husband have no assets, apart from 2 cars worth less than $7000.00 (aust) and some furniture.

She and her husband earn around $100K (aust per year).

After she pays her debts she is left with less than $50.00 per week to live.

I'm going to advise her to look at bankruptcy as an option. Can you please tell me how this will affect her credit rating in Australia?

While there is no direct link, for the purposes of credit rating, it is possible that the UK authorities could pursue and seize the Australian assets.

So in your expert opinion you honestly think that the UK officials would pursue the clients even though they have less then $10,000.00 (5000 pounds) in assets in Australia??

The statutory fees which would be expended in such a cross-border exercise would render it unlikely, in the extreme, but it would be wrong to ignore the possibility.
