Verified<p>hi there</p><p> </p><p>if her ex will not vacate the property voluntarily, then your daughter's only option is to apply to the court for an order to sell the property or rent it out.</p><p> </p><p>My advice would be to apply to the court to sell the house. Otherwise, your daughter will continue to be jointly and severally liable for the mortgage payments if her ex defaults on the payments in the future. This could happen if the property is not rented out because the tenant has moved out etc</p><p> </p><p>In the meantime, if your daughter can afford it, she should meet the mortgage payments on the property to prevent the house being repossessed.
