VerifiedUnfortunately, if the mortgage is in joint names then she cannot avoid responsibility in the event that the partner defaults. In theory she could sue him if he has negligently or wilfully dispersed the cash for improvements but we already know he is worth nothing.
The bank are unlikely to allow her to come off the mortgage in the circumstances.
Her only option may be to try to get the house sold and the mortgage redeemed - but will this not cover the mortgage and the loan?
