Apologies I could not see a section for driving offences.

My son had two sets of three points (fixed penalty speeding, one private and one for work) already on his licence, he was then stopped driving his offroad motorbike on the road and received six points (driving with no insurance and no MOT). He has been to court and pleaded not guilty. At the time of going to court his licence was with the DVLA having his licence updated as he has now passed his full motobike test but he has not received his licence which when returned has to be sent again to the DVLA for his six points to be added. Technically he has 12 points - can he drive ? and can he appeal as this could lose him his job.

Disqualification under the 'totting up' rule is neither automatic nor mandatory. He has not been disqualified and can still legally drive. He has been very fortunate in slipping through the net.

That is fantastic news, how can Ibe 100% sure that 'he has slipped the net', would he have been told in the adivsory note from the court that he had been banned or does it mean that because he hasn't been told then he hasn't been banned.

If he has received notification which relates only to a fine and penalty points then he has not been banned.
