Hi, My girlfriend has had a child with a previous man, Tom, her son is now 6 years old and Steve the Ex has sent her a letter from his solicitor asking for parental responsibilty. He is often Drunk and drives with his son in the car, He shows him over aged films and programs and plays mind games with him resulting in nightmares and night terrors. Unfortunatley we have no proof of his misdemenors and are worried the courts will just ignore this as hear say!! As Tom appears to love his father, his mother has never denied him a weekend with his father and has been told that because of this the courts will rule against her and will award Steve the PR that he wants.. She is also worried that with this new power over her he will use to ruin her life with no regard for Toms well being.... any advise would be greatly appreciated, Should we stop Steve seeing his son now????

This will not give steve any new power over your partner, it will simply give him the right to speak to the school and any health professionals involved in the childs life.

You must not stop the contact as this would go very badly against your partner in court. The only difficulty that him having parental responsibility could have is that if he dis not return the child after contact your parter would have to seek an emergency court order to get him returned. it would happen, but no doubt the twenty four hour delay would be distressing.

The way round this is to say that she will only agree to pr if he agrees to her having a residence order - any court would be sympathetic to this request and it would mean that if the child wasnt returned the police would recover him

Clearly the issues over the driving an inappropriate viewing do need to be addressed and your partner should talk to the school to see if his teacher has noticed any behaviour attributable to the viewing. be aware however that this is unlikely to effect the pr issue
