my partner and I bought...

my partner and I bought a house together. He keeps telling me he wants a devorse. I told him to go ahead. He said he will do it when he is ready as the house does not have in any equity. In the mean time every day we argue and he calls me all manner of names. He swears at me and accuse me of starting an argument all the time. If I reapondto anything he says to me he accuse me of shouting. When he comes in the house he is alwys finding something to blame me foreg. leaving the light on, leaving the tap running. he calls me childish and immature all the time. I feel like a child in my own house. what can I do

sorry to hear of the problems that you are experiencing with your husband.

If you agree with him that the marriage has come to an end, there is nothing stopping you from getting a divorce from him. It certainly sounds although you have grounds to do so based on his unreasonable behavior towards you.

Once you have started the process, although it doesn't force him to leave the home, at least you would be able to get the Court involved and set a definite timescale for things to move forward.

As you are joint owners of the home, no one can force you - or him to leave. You will not loose any rights to the property if you think that things are so bad that you have to leave and he cannot sell it without your permission.

If you have solicitors involved to start the divorce then you can ask that they write to your husband asking him to leave, or at the very least behave in a better way towards you.

Your daughter's needs will be 'paramount' in this case and in the event that she is to remain in your care then your housing needs will be a prioirty and you may have more than a 50% share of the family assets as a result of any settlement.

As there is a young child in the home, it becomes more and more important that something is done about your husband's behaviour and to that end I would certainly repeat my advise about seeking a divorce yourself so that things can move on as quickly as possible.

In the event that your husband tells you he wants to have your daughter living with him then I would advise this is highly unlikely as I presume you have cared for her this last 12 months. She would only be taken from your care if she was in danger.
