Can a father stop the mother of his child moving the child

Resolved Question:

Can a father stop the mother of his child moving the child away, the father feels the distance to far to continue to see the child on a regular basis. The couple have been married for 10 years and have recently seperated, the mother has a new partner who she wishes to live with. No one has filed for divorce yet but it will be soon. S o can the mother do this ??

No, I'm afraid the father cannot stop the mother from moving away with the child, provided the move is within England and Wales. The court would not interefere with this right. However, she may be required to contribute to the travelling costs so that you can maintain contact with your child or bring the child mid-way between your address and her new address so that you can collect the child from there.

can a house be put on the market if you are joint owners and divorce hasn't been started or the agreements over a child etc finalised??

You could make a specific issue appliation to stop the child from being moved away but it's unlikely to be granted in the circumstances.

Yes, you could put the house on the market now before the commencement of divorce proceedings and before any agreements over the child has been finalised,etc. with the consent of your wife.
