It is regarding secondments and redundancy , :I am haveFor Ben Jones:I am have been seconded to a Grade 3 senior management post (higher grades being more senior) for approx 8 months. This Grade 3 post was a new post in an interim structure while our area was under review. Prior to this secondment I was in a Grade 2 post as a regional officer. I understand this is sometimes classed as a substantive post, however I have just noticed that there is no wording to this effect in my secondment contract, it has just been done as a general FTC. I didn't notice this at the time of signing but there had been talk of me returning to the grade 2 post if I didn't feel the grade 3 was right or if it wasn't required in the new structure.Before the interim structure came into play, there were 4 regional officers, although one of these was a vacancy which hadn't been filled. The interim structure saw the 4 regional officers reduced to two with an expansion of area but with an extra layer of management introduced by way of 2 temporary grade 3 posts - one of which I am seconded to, and the other secondee to grade 3 is one the other grade 2 regional officers. The grade 3 secondments were internally advertised. Only myself and my colleague applied. When we were seconded, my post was backfilled by way of a FTC with the remaining grade 2 colleague continuing in her role with the expanded area. The review of our area is now complete and the interim structure for our team will be made permanent. I have been advised that my substantive post is at risk of redundancy as the headcount of three (plus a 4th vacancy) is reducing to two. I am also advised that I need to apply for the perm grade 3 opportunity even though I have been doing an excellent job (this is the feedback) for 8 months. Bearing in mind that there is no substantive clause in my secondment FTC (although this was verbally mentioned back then), and the secondment post is now a permanent requirement, can they make me apply for it? There is no one else at risk of redundancy who could do my seconded role (at least in my view) and in any case they didn't take the opportunity to apply previously. Even if there was a substantive clause, would they still have right to make me apply for a job I'm doing that is required indefinitely? Surely it should be a case of checking I am happy to continue in this post and confirming me, otherwise then putting me at risk of redundancy from substantive post (providing they can rely on 8 month old discussions that aren't documented and I can't remember exactly what was said)? … read more
