I'm Lucy, and I'd be happy to answer your questions today. I'm sorry to hear that this happened. One way to avoid points is to request a trial and successfully defend against the ticket. That typically requires establishing that your husband was not speeding, or that the police officer wasn't able to properly evaluate his speed - due to weather, lighting, angle, obstructions to his view, or similar factors. You'd have to go to Maine for the trial, which unfortunately could cost nearly as much as the ticket. That's not feasible for many people, especially since there are no guarantees that it will work. Under Georgia law, a driver can request a reduction of up to 7 points once every five years. If your husband has other violations on his record, he could use that procedure to reduce the points. A young deputy said I was going 77 mph in a 55 zone (state highway near my home in very rural western SC. I was driving my husband back from Augusta and an appt. with his ophthalmologist, and his eye was dilated--but he said he did not sense that I was speeding. It was dark, roads were dry though it had been raining for much of the hour's journey. The traffic at this point was light, though it had been heavy on the interstate and the long detour around a bridge construction site. We were tired and had received some more bad news about his eye, after three serious eye surgeries this year and months of gas in his eye and treatments.I had just passed a truck that was raining grit down on my car which is a 2011 Hyundai Genesis. The truck was speeding up and slowing down and was difficult to drop way back from. As I passed him, pulling beside him, he speeded way up and I was trapped in the passing lane for a few seconds, and had to speed up more to pass him. When I was around him I took my foot off the gas (my car slows instantly even without braking), and resumed my cruise control which I think was set at 64,and I used the windshield wipers to clear the grit off the windshield. A car going in the other direction flashed brights at me (I thought)--this happens a lot because my Genesis halogens are very bright and have a huge lateral distance. So I thought nothing about that--but it was the sheriff flashing his blue lights at me, he said. I pulled into a gas station as I was nearly out, and the sheriff was waiting at my door when I opened it to get gas. … read more
