Yes, it is a problem because if the owner does not have at least the title, you would have an issue registering the vehicle if you repair it. If you are buying from the legal owner, then they can apply for and obtain duplicate title and they need to do so or later down the line you will have an issue trying to register or even sell the vehicle.

If the seller never had title, they will have to go to court and send a notice to the last registered owner and get the court to issue an order to clear the title and issue title in the seller's name and this would cost about $800 for an attorney to get done.
