The problem could be with the vehicle but it's more likely to be the fob. If the battery has been replaced then the next step will be to see if it is transmitting, and that will determine whether the fob needs to be replaced or the failure is on the vehicle and deeper electrical testing will need to be done.

Most big chain parts stores such as Autozone will test fobs for free. If it is not transmitting then it will need to be replaced. If it does transmit when the buttons are pressed then a scan tool will be necessary to further diagnose the problem.
