I have a messy one... A $25K loan was given to an S-Corp
A $25K loan was given to an S-Corp owned by my brother and his spouse. I'm an individual. The Balloon Loan dates back to 2005 and I'm aware that the statute of limitations has run out. I had expected to get paid back eventually and wasn't counting on my brother getting divorced and that his EX would end up with the business. She's likely aware that the SOL has run out as she hasn't replied to my requests for payment (Dec 2016).As an individual it looks like I'm not required to file a 1099-C. HERE'S MY QUESTION: I was wondering if I need to file A 1099-C in order for me to claim the principal as a loss for tax purposes? There was a loan agreement and was on the Balance Sheet and their TAX RETURNS as a business debt. I was thinking of using the "filing" of the 1099-C to try to get them to pay me something (~$10K). Better me than the IRS?? They are in a low bracket so there's little financial incentive for them. I'm in almost the highest bracket. The loan was on their books with no accrued interest, and none was accrued, paid or claimed as income. Assuming that doesn't matter that much at this point. I'm trying to get paid something as I'm tight for cash and I'm owed the money. I know I'm asking a lot for "free" advice and I'm not in a good position. … read more
