In brief, it doesn't matter that you do not have income, you are still able to file married filing jointly. The return will just show the income of your spouse. SEE BELOW:

You use the Married Filing Jointly status to include all you and your spouse's income, exemptions, deductions, and credits on one tax return. Even if you or your spouse had no income or deductions, you can still file a joint return.

I feel the answer was fair although I would prefer to know what the law requires and if changing the filing status is an audit alert.

As you are legally married, and living together, even though you do not have income, he cannot file Head of Household. Being considered married on the last day of the year allows for a married couple to file married filing jointly, or married filing single. Head of Household is not an option for him.
