I am retired and my only income is SS retirement benefits. My wife works and will make about $40,000.00 in 2017. I want to file married filing separate for 2017 - avoiding an any tax on my SS benefits Can I do this?

You woudl have to look at half your SSA benefits to see if you are required to file. Generally you look at all your other income and half your SSA benefits to see your BASE amount for SSA taxable. If you file MFS your BASE amount is $0, That means that half your SSA is considered taxable.

If half of the SSA is enough to require you file then you will find that you will owe when you file.

If half your SSA is at least $9,325 then you have to file.

I personally have zero other income. I understand that if SS is my only source of income, it is not taxable. Yes? No?

It depends on how much your SSA benefits are

I have a retirement income question. 5 years ago I retired
5 years ago I retired and moved to New York. I receive two retirement checks, one from the San Francisco Fire Department and one from California Public Employees Retirement system. Last year I found out that my checks were still having Calif. State income tax removed yet I was paying NY State income tax. I was being double taxed. So I had the retirement agencies stop withholding CA tax. I researched the issue and found that the 1995, Public Law 104-95 made it illegal for states to tax retirement income of individuals no longer residing in their state. Now my tax preparer says I owe tax for NY and for CA. She says it is a part of her tax program and it asks for an accounting of any "income earned as a non-resident derived from California?" When she puts our earned amount in that box she says the program says we owe CA $1,800, yet we are paying NY a similar amount.
