My ex husband recently passed...
My ex husband recently passed away. We were married 27 years and had 4 children. We both remarried and his wife passed away 2 years ago. Am I able to get social security on his past income?

Customer: My ex husband recently passed away and his wife also passed away. During our 27 years of marriage, I did not work. Am I able to claim any of his social security benefits?

Customer: I was 45 when we divorced and worked until 60, so my SS benefits are not much. Someone told me I would be eligible for his SS.

If you are divorced, but your marriage lasted 10 years or longer, you can receive benefits on your ex-spouse's record (even if they have remarried) if:

  • You are unmarried;
  • You are age 62 or older;
  • Your ex-spouse is entitled to Social Security retirement or disability benefits; and
  • The benefit you are entitled to receive based on your own work is less than the benefit you would receive based on your ex-spouse's work.

Unfortunately, because you are remarried, you cannot collect on your ex-spouse's social security benefits.

5 years ago I retired and moved to New York. I receive two retirement checks, one from the San Francisco Fire Department and one from California Public Employees Retirement system. Last year I found out that my checks were still having Calif. State income tax removed yet I was paying NY State income tax. I was being double taxed. So I had the retirement agencies stop withholding CA tax. I researched the issue and found that the 1995, Public Law 104-95 made it illegal for states to tax retirement income of individuals no longer residing in their state. Now my tax preparer says I owe tax for NY and for CA. She says it is a part of her tax program and it asks for an accounting of any "income earned as a non-resident derived from California?" When she puts our earned amount in that box she says the program says we owe CA $1,800, yet we are paying NY a similar amount.
