Unfortunately there is no statute of limitations on taxing agencies in the state of

PA. sorry.

Is my employer responsible for the tax or my tax preparer for missing it?

I had 4 jobs in 2002 and one of them (in DE) missed the tax.
If your employer did not deduct taxes from your check, you are still responsible but you may be able to sue them and win for damages due to their failure to pay taxes. Your tax preparer may be liable if they knew you should have paid taxes or do not have a defense for failing to catch that error. But ultimately it is your responsibility and you will have pay the penalty and then sue the preparer for the penalties you incurred.
