Can my step father file as single

Resolved Question:

For 30 years my mom and stepfather have filed joint returns. My mom has lived in a nursing home since April 2007 and has her own income and enough medical expense to claim itemized deductions. My stepfather has no deductions. Due to family issues, my brother who has power of attorney, will not file a joint return. Can my stepfather file as single even though they are married since they are not living together?

When a taxpayer is married they have two filing options, married filing jointly or married filing separately. In your scenario, both spouses will file married filing separately. Your father will be required to to itemize deductions if your mother itemizes deductions due to the nursing home costs.
