I sold my house in January 2012 and paid the 3% tax retention.

I sold my house in January 2012 and paid the 3% tax retention. I made a loss on my house so didn't make a profit. I have not yet received this money back. I was a non-resident and retained a lawyer to pay all taxes every year from 2002 (I have receipts) originally this was for Wealth Tax and Income Tax but the last few years only Income Tax was due. I have made sure I paid everything so there is no reason why money should be withheld. Can you help please with any advice ? I would be most grateful.
