My husbnd has been...

My husbnd has been falsely accused of pointing a firearm at potential hijackers of our truck a while ago. It slipped from his waist band down his trouser leg to the floor and he merely picked it up to put it back I his vehicle when he saw that there was no immediate danger. now the SAPS want to come from Middelburg and arrest him!!!!!

The SAPS phoned our ex Manager who was a witness to ask what is my husbands present address and phone number but they have not yet phoned him???? They already interviewed him about a year ago then nothing.....now its comingup again so I don't know whether they now have a court date and they have 4 or 5 false witnesses who are wanting to testify that he pointed the firearm at them which he didn't.!!! His manager was with him at the time and can testify to the fact that he DIDNT point a firearm at ANY OF THEM

The best advice I can give you is to get an attorney who specialises in criminal law to be on stand-by for your husband.

The reason for arresting a person is to get him to appear before Court, it is not meant to be a threat or punishment.

If you get an attorney, he can in the meantime contact the investigating officer and arrange that your husband will appear in Court if a Court date has been obtained. Then an arrest would not be necessary, but if the SAPS does arrest him, the attorney can immediately apply for bail.

Should the matter proceed to Court, it will be a matter of testimony and the Court will decide whether you husband pointed the gun or not. I cannot make any informed opinion on that.
