Halo. Ek werk al 3 jaar in n bar my baas het my ure verminder hy ht my weeksdae weg gevat dat ek net vrydae en saterdae nu moet werk. Hy het my ni in kennis gestel ni hy het dit eers aan di pebliek bekend gemaak voor ek enige iets geweet ht. Hy weier om my verlof uit te betaal. Hy ht my vrydag mondeliks in kennis gestel en gese ek moet my verlof di maand vat vanaf maandae tot donderdae en dan betaal hy my nt 3 tot 4 ure n dag uit en die ander uitstaande 5 dae van my verlof sal hy die einde vani maand betaal. Ek verstani dat hy my nou oorsit as n naweek casual ni ma ons ht n kontrak. Mag hy dit so dun of ni

Jou werkgewer se optrede kom neer op 'n onbillike arbeidspraktyk.

Jy is geregtig op betaalde verlof, en indien jy verlof neem. Wanneer jy verkof neem, moet jy steeds ten volle betaal word. Hy kan nie vir jou net 3-4 ure betaal nie - hy kan jou ook nie verplig om verlof te neem nie.

Hy kan verseker ook nie jou diensvoorwaardes eensydiglik wysig nie. Jy is 'n permanente werknemer - hy kan dit nie verander na 'n naweek "casual" pos nie. Indien hy dit wil doen, moet hy 'n baie spsifieke proses volg wat voorgeskryf work in artikel 189 van die "Labour Ralations Act" - indien die verandering van jou diensvoorwardes noodsaaklik is vir die besigheid se bedryfsvereistes. Dit is nie 'n eenvoudige proses nie.

So, in kort, nee, jou werkgwer kan nie doen wat hy besig is om te doen nie. Indien hy voortgaan kan jy 'n klagte by die CCMA aanhangig maak.

angesien hy my nu mondeliks in kennis gestel ht moet hy my die maand laat uitwerk en dan laaste maand se pay en my verlof uitbetaal?

Nee, hy kan jou nie mondeliks van enige iets in kennis stel nie.

Jy kan aansoek doen vir verlof, en hy moet dit toestaan of weier. As hy dit toestaan, dan moet hy jou betaal terwyl jy op verlof is.

Jy is geregtig om elke dag, voldag te werk, soos per jou kontrak. Hy moet jou elke dag, voldag betaal.

Onthou asseblief om die antwoord positief te "rate".

Nog net een vraag asb hy ht gese ek muni di weeks dae di maand kom werki ek mut dit aftek van my verlof ma ek wil dt ni so duni. Mut ek ga werk of wat mut ek doen

Ja, meld aan vir werk.

Jy kan net vir jou werkgewer sê jy stem nie saam nie en daar is geen wetlike gronde waarop hy jou kan verhoed om te werk nie, of om jou te verplig om verlof te neem nie.

Jy aanvaar ook nie sy eensydige verandering van jou werksure en/of diensvoorwaardes soos hy probeer doen nie.

Hy stuur nu ve my hy soek n bedankings brief. En dan mut ek my verlof need want verolf word ees uitbetaal na diensbeeindiging.

Wil jy bedank?

Indien wel, is die keuse joune - normaalweg word verlof nie geneem in die kennis tydperk nie, maar jy en die werkgewer kan ooreenkom dat jy wel verlof neem gedurende die tyd. Dit sal basies beteken dat jy betaal word vir die maand (aan die einde van die maand) en dan geen verlof het wat uitbetaal moet word nie.

Alternatiewelik, gee jy nou een maand kennis, werk die maand (en word betaal) en dan moet die werkgewer jou jou salaris en enige uitstaande verlof geld betaal aan die einde van die maand.

Dit is jou keuse.

Dis nie sy keuse nie. Dis so maklik soos dit.

As hy nie daarvan hou nie, moet hy stappe neem om jou te ontslaan. Dit behels in die eerste plek dat jy een of ander oortreding moes begaan het, en dan moet hy 'n dissiplinere verhoor hou, en dan, indien jy skuldig bevind word, en die oortreding was ernstig genoeg, mag hy jou dalk ontslaan.

As ek nu sy sin ve hom gee en my verlof vat kan ek hom dan se ek vat als gelyk en dan help ek oki naweek uit ni en dan betaal hy nu nt my verlof ve dai maand en dan ek kla. Maar as ek n verlofdag vat dan betaal hy nt ve 4ure n dag uit. Of ek kan ve hom se ek sal my verlof vat deuri week en naweek uit help tot einde Aug ma dan mut hy my 8 ure n dag verlof uitbetaal?

Ek dink hy/jy probeer dinge kompliseer.

Dis eenvoudig, as jy een dag verlif vat, moet hy jou daardie dag steeds betaal asof jy vol dag gewer het.

As jy byvoorbeeld 20 verlof dae opgehoop het, dan is jy geregtig om 20 dae agtereenvolgend verlof te neem en moet hy jou betaal vir daardie 20 dae (presies soveel soos hy jou sou betaal het indien jy wel gewerk het).

So, as jy op verlof is, sluit die uiteraard naweke in.
