Customer Question

Hi i got served summons for my outstanding levie amount, i had financial difficulties and i couldn't afford much, therefore my levie bill is 8 months behind,
i met up with the attorney who served me with the summons of R8879.05, but when they give me the legal fees it goes up to R28961.14,
this cant be legally right, coz i asked to pay the full R8879.05 but they say i need to pay the R28961.14.
they made a proposal that i pay R3900 a month, which i agreed to but i counld pay it in september 2016, i was going to be able to pay it at the end of October 2016 plus my normal levie of R1000,
but the attorney said hes not willing to negotiate,
now they want to attach my furniture,
please help to resolve this issue-Johannesburg

Good morning,

I will need to ask a few questions in order to advise you on the appropriate course of action.

  1. When was the summons served on you?
  2. When did you reach the agreement to pay the debt in installments?
  3. Did you sign an acknowledgement of debt after this agreement? If not, did you sign any document to record the agreement with the attorneys?
  4. Do you know if they obtained judgment against you?
  5. Did the attorneys give you a breakdown of their fees?
  6. Was a warrant of execution served on you yet?
  7. Did you communicate in any way with the Body Corporate's trustees?
