VerifiedI had heard that if a woman was married for more than 10 years they could claim their husbands social security if his was more than hers.
That is not true if the person is living. You can only get a spousal benefit which allows you to get a portion of your ex's amount, not all. That amount is UP TO 50%, and since you applied at early retirement, the spousal benefit is reduced to 32.5% of his benefit. You can switch to that amount if it is higher than the amount on your own record.
The lady at the SS office told me that if he was still working I could not do that. I think she was wrong. I m now 65 years old.
You can do take a spousal benefit but if you are still working, it is subject to the earned income penalty (just like your normal benefit). It would be reduced by $1 for every $2 over $18,240.
