Background 1. In our divorce agreement my ex agreed to pay me $750 per month to buy out my half of the business we owned together. 2. The payment amount was tied to the fact that she received a monthly Social Security check in the amount of $750 per month 3. It was also agreed that if my ex didn't continue to receive the Social Security payment she would owe me no further payments. 4. After the divorce agreement was finalized, I received her first payment right on time (her personal check in the amount of $750). 5. About two weeks later her attorney emailed me and informed me that the payments to me would be cancelled because we would have had to be married ten years for her to continue to receive the check. 6. I now have reason to believe - five years later - that my ex has continued to receive the monthly check. I have sent a report to the Inspector General and contemplating a law suit for fraud. Question: A. Do you believe that my ex received a letter from SSA notifying her that her payments would be cancelled? I understand the IG does not divulge their findings in a investigation, but timing is important to me. B. Do you know how long on average does it take for SSA to begin an investigation (ie: big back log?) and do you believe that my ex would be interviewed or notified in any way of the investigation? C. Do you believe that it was incumbant on my ex to notify SSA that she no longer was qualified to receive the monthly checks? (She obviously knew since she stopped the payments to me per the ten year marriage rule. … read more
