Customer Question
Hi, my husband passed...

Hi, my husband passed away almost 3 years ago. I had a brief marriage after that. Does that marriage keep me from collecting my late husband's SS?

Accountant's Assistant: The Retirement Accountant will know how to help. Please tell me more, so we can help you best.

My brief marriage lasted just over a year. But I wonder if it is annulled, will that still allow me to collect my late husband's Social Security benefits?

If you remarry before you reach age 60 (age 50 if disabled), you cannot receive benefits as a surviving spouse while you are married.

If you remarry after you reach age 60 (age 50 if disabled), you will continue to qualify for benefits on your deceased spouse's Social Security record.

Let me kno wif you need help with further processing.

because i'm divorced from that marriage, do I still qualify to receive his benefits?
Social Security Expert: lev-tax, Tax Advisor replied 7 months ago

Yes - as long as you currently not married - you do qualify.
