I'm going through a divorce. My wife is 52 and I am 65 and haven't started taking Social Security. I meet all the criteria to collect half of her Social Security earnings without affecting her. What does "Entitled" refer to with regard to her. Can I only collect if she is 62 or more or "Is she entitled because she has paid into Social Security over her lifetime?

Accountant's Assistant: The Retirement Accountant will know how to help. Is there anything else the Retirement Accountant should be aware of?

No I am just wondering if she is "entitled" at 52 or if I can collect only if she is 62 or more?

If you’ll please bear with me for a minute I’ll type up my initial response, and then we can go from there if you have further questions on this.

You can collect a spousal benefit as long as you are 62, and as long as your spouse is 62 – even if your ex has not filed for their own benefits yet.

HOWEVER, the reduction in benefit (reduced benefits at 62), is based on your age not hers ... so you WILL be entitled to the full 50% of her FULL retirement age amount once SHE turns 62

The other limitation rule that might apply won't apply here either; "If your ex-spouse has not applied for retirement benefits, but can qualify for them, you can receive benefits on their record if you have been divorced for at least two years."
