I have been recieving spouse survivor benefits and my income has exceeded the allowable amount. Do I have any options as we (before my wifed passed away)depended on the income. I am 63.

HI, MY NAME’S LANE - I hold a law degree (J.D.), with concentration in Tax Law, Estate law & Corporate law, an MBA in finance, a BBA, and CFP & CRPS (Chartered Retirement Plans Specialist) designations, as well - I’ve been providing financial, Social Security/Medicare, estate, corporate, non-profit, and tax advice 1986.

The only real option you have is to voluntarily stop the payment for a couple of months of months or so by calling the 1-1800 number and telling them that you are over the annual earnings limit.

Becasue you are under age 66 you can't actually suspend the benefit.

...

Now, if you have been receiving the benefits for less than 12 months, you can pay it back and WITHDRAW the survivors benefit application. This will let your benefit grow to 100% of her benefit if you don't file for it again until you are full retirement age (age 66 for those born 1943 through 1954)

OR you can do nothing and they will (upon receiving the information from IRS) stop the payments until your overpayment amount has been recouped.
