Is it true that I can file for spousal benefits from my ex-husband?

Accountant's Assistant: These retirement benefits are supposed to help us but they can be so complicated! The Retirement Expert will help you get the most benefits propertly. Please tell me more, so we can help you best.

I will be 63 in November, however, he will be 65 in Dec. If I am able to draw benefits under his SS#, what would be the impact if I am still working?

Accountant's Assistant: Is there anything else the Retirement Accountant should be aware of?

Yes - that is correct.

If you are divorced, but your marriage lasted 10 years or longer, you can receive benefits on your ex-spouse's record (even if they have remarried) if:

  • You are unmarried;
  • You are age 62 or older;
  • Your ex-spouse is entitled to Social Security retirement or disability benefits; and
  • The benefit you are entitled to receive based on your own work is less than the benefit you would receive based on your ex-spouse's work.

We were only married for five years. I have since remarried - my husband is receiving social security disability benefits. I am 62, will be 63 in about 7 weeks, but based upon your answer above, it does not look like I can draw benefits from my ex.

Unfortunately - if your marriage lasted less than 10 years - you would not be eligible for social security benefits based on your ex-spouse working record.

All other facts woudl not be relevant in such situation.
